Alpine Elite Real Estate Solution

This Agreement is made between Alpine Elite Real Estate Solution ("Inspector") and the undersigned client ("Client"), collectively referred to as the "Parties."

By signing this Agreement, Client acknowledges that they have read, understood, and agree to the terms and conditions outlined herein. The inspection will not be scheduled or performed without acceptance of this Agreement.

1. Purpose and Scope of Inspection

The purpose of the inspection is to provide the Client with a professional, limited visual inspection of the readily accessible and visible major systems and components of the property on the date of the inspection. The inspection is intended to identify significant defects or deficiencies observed at the time of inspection.

The inspection and report are performed and prepared for the exclusive and confidential use of the Client.

The inspection is not technically exhaustive and does not include dismantling or destructive testing. The inspection will be conducted in accordance with the Standards of Practice of the International Association of Certified Home Inspectors (InterNACHI) unless otherwise specified.

2. Exclusions and Limitations

The following are outside the scope of the inspection:

  • Building code or zoning ordinance compliance

  • Pest or rodent infestation

  • Mold, mildew, asbestos, radon, lead paint, or other environmental hazards

  • Pools, spas, or fountains

  • Underground utilities or septic systems

  • Condition of detached structures (e.g., sheds, barns) unless specifically requested

  • Cosmetic issues (paint, wallpaper, carpeting, minor cracks)

  • Engineering analysis or load calculations

  • Systems not readily accessible (blocked, locked, sealed, hazardous)

Inspector does not offer guarantees or warranties of any kind, expressed or implied, regarding the future condition of the property.

3. Client Responsibilities

  • Client agrees to secure permission for Inspector to access the property.

  • Client is encouraged to attend the inspection and ask questions.

  • Client acknowledges that Inspector is not responsible for hidden or latent defects not discovered during a visual inspection.

  • Client shall notify Inspector in writing of any complaints regarding the inspection within 10 days of discovery.

4. Inspection Fee and Payment

The total inspection fee shall be [Insert Inspection Fee], payable in full before or at the time of the inspection, unless otherwise agreed in writing.

No verbal agreements or modifications shall alter this fee arrangement.

5. Limitation of Liability

The Client agrees to hold harmless, indemnify, and release Alpine Elite Real Estate Solution, including its inspectors, employees, agents, contractors, and affiliates, from any and all liability, claims, losses, or damages, whether direct or indirect, arising out of or in any way related to the inspection services provided.

This includes but is not limited to:

  • Claims based on missed, undetected, or hidden defects

  • Injuries sustained at the property before, during, or after the inspection

  • Loss of use, repair costs, remediation, relocation, or lost income

  • Any actions or decisions taken based on the inspection report

  • Third-party claims or disputes arising from the inspection or report

The Client expressly acknowledges and agrees that:

  • The inspection is limited in scope and based solely on visible and accessible areas at the time of inspection.

  • The inspection is non-invasive and does not include moving personal items, dismantling systems, or entering inaccessible or hazardous areas.

  • The inspection does not guarantee the future performance or condition of any system or component.

As such, the Client agrees that no monetary compensation, refund, or payout of any kind shall be issued by Alpine Elite Real Estate Solution for any reason, including but not limited to:

  • Missed or undetected issues

  • Future failure of any system or component

  • Bodily injury occurring at the property

  • Any other damages, direct or consequential, resulting from or related to the inspection

This clause is a material part of the consideration given by the Client in hiring Alpine Elite Real Estate Solution, and is agreed to willingly and with full understanding of its legal effect.

6. Dispute Resolution

In the event of any dispute, the Parties agree first to attempt to resolve the dispute informally. Failing informal resolution, any legal action shall be brought in the jurisdiction where the property is located.

7. Severability

If any portion of this Agreement is deemed invalid, the remainder shall remain in full force and effect.

8. Entire Agreement

This Agreement represents the entire understanding between the Parties. No verbal statements or prior writings shall modify or supersede this Agreement.

Radon Testing Agreement

Alpine Elite Real Estate Solution

This Agreement is made between Alpine Elite Real Estate Solution ("Company," "Inspector," "we," or "us") and the undersigned client ("Client," "you") for the purpose of conducting a short-term radon measurement test at the property listed below.

Your signature confirms your understanding and agreement to the terms below.

2. Purpose of Testing

The purpose of the radon test is to measure the concentration of radon gas at the property using a short-term testing method. This test is not a guarantee of future radon levels and is intended only to measure the level at the time of testing under controlled conditions.

3. Testing Method

We will use EPA-approved equipment to conduct a short-term radon test, typically over a period of 48–96 hours, depending on the method used.

Radon devices will be placed and retrieved according to EPA protocol and the test will be conducted under closed-house conditions.

4. Client Responsibilities

To ensure valid test results, the Client agrees to:

  • Maintain closed-house conditions (windows closed, doors shut except for normal entry/exit) 12 hours prior to and throughout the testing period

  • Avoid tampering with or moving the radon monitor/device

  • Keep HVAC systems set to typical living conditions

Failure to comply may invalidate the results.

5. Limitations of Radon Testing

  • This test provides a snapshot of radon levels over a short period and may not reflect long-term exposure.

  • Seasonal and weather conditions can affect readings.

  • No warranty or guarantee is made regarding future radon levels or health outcomes.

  • The test does not detect mold, VOCs, or other indoor air pollutants.

6. Reporting

Results will be provided in a written report within 1–2 business days after the test concludes. The report will include:

  • Average radon concentration in pCi/L

  • Description of the test conditions and method

  • Interpretation per EPA guidelines

7. Fees

8. Liability Limitation

The Client agrees that the Inspector’s total liability for any claims, damages, or losses arising from the radon test shall be limited to the amount paid for the testing service.

9. Acknowledgment of Risk

Client understands that radon is a naturally occurring radioactive gas and the EPA recommends mitigation for radon levels ≥ 4.0 pCi/L.
Client acknowledges that Alpine Elite Real Estate Solution is not a radon mitigation company and does not perform corrective services.

10. Entire Agreement

This Agreement represents the full understanding between the parties. No verbal agreements or other representations shall modify this Agreement unless in writing and signed by both parties.

Sewer Scope Inspection Agreement

By signing this agreement, Client acknowledges that they have read, understood, and agree to the terms and conditions of the sewer scope inspection service as outlined below.

2. Scope of Inspection

The sewer scope inspection consists of a visual examination of the interior of the main sewer line (typically from the cleanout or toilet to the municipal tie-in or septic tank) using a video inspection camera.

The purpose of this inspection is to:

  • Identify visible blockages, damage, or defects in the accessible portion of the main sewer line.

  • Provide video documentation and a written report of observed conditions.

3. Limitations and Exclusions

The Client agrees to hold harmless, indemnify, and release Alpine Elite Real Estate Solution, including its inspectors, employees, agents, and contractors, from any and all liability, claims, losses, damages, or expenses, arising out of or related to the sewer scope inspection, including but not limited to:

  • Undetected damage, deterioration, blockages, or defects in the sewer lateral or related components

  • Damage to plumbing fixtures or cleanouts that may occur during normal camera insertion or retrieval

  • Inability to access or fully inspect the entire sewer line due to obstructions, collapsed lines, root intrusion, excessive bends, or non-standard materials

  • Interpretation or reliance on findings by third parties, including realtors, buyers, sellers, or contractors

  • Consequential damages, such as repair costs, replacement costs, backups, flooding, or use restrictions

The Client acknowledges and agrees that:

  • The sewer scope inspection is limited to a visual video inspection of the interior of the accessible portions of the main sewer lateral only, typically from the cleanout to the city tap or septic connection.

  • The inspection is non-invasive and does not involve excavation, pressure testing, or any repair or cleaning services.

  • The findings represent the observable condition at the time of the inspection only and do not guarantee future performance or function of the sewer system.

  • Root intrusion, pipe degradation, obstructions, or partial collapses may worsen over time and may not be fully visible or diagnosable during the inspection.

Because of these limitations, the Client agrees and understands that no refunds, payouts, or compensation of any kind shall be issued, including for:

  • Missed or hidden defects

  • Sewer line failure after the inspection

  • Future sewer backups, flooding, or related property damage

  • Injuries, property access issues, or repair expenses related to any findings or undetected conditions

By signing this agreement, the Client accepts all risks associated with the inherent limitations of a sewer scope inspection and agrees not to hold Alpine Elite Real Estate Solution liable for any costs, damages, or losses related to sewer line performance, condition, or repair needs—whether known or unknown at the time of inspection.

4. Risks and Potential Outcomes

  • The sewer line may be obstructed, collapsed, or partially inaccessible.

  • The camera equipment may not be able to complete the full line due to blockage, design, or configuration.

  • Camera insertion through a toilet or plumbing fixture may result in minor cosmetic damage, which is a known risk accepted by the Client.

If access is not possible or if the line cannot be fully inspected, the fee is still due for the portion completed.

5. Client Acknowledgment and Responsibilities

Client acknowledges and agrees that:

  • Inspector is not responsible for the condition of lines that are not visible or accessible.

  • Inspector is not responsible for damage caused by pre-existing conditions (e.g., fragile or deteriorated piping).

  • Client must arrange access to the property and, if applicable, ensure pets and occupants are prepared for interior access if needed.

6. Reporting

A digital video and/or written report will be provided within 1–2 business days after the inspection, summarizing findings and recommendations based on visible conditions.

Reports are for informational purposes only and are not a warranty or guarantee.

7. Fee and Payment

Wood-Destroying Insect Inspection Agreement

This agreement is made between Alpine Elite Real Estate Solution ("Inspector") and the undersigned client ("Client") for the purpose of conducting a Wood-Destroying Insect (WDI) inspection at the property described below. This inspection complies with the standards and format of the NPMA-33 (National Pest Management Association Form No. 33).

3. Scope of Inspection

  • No probing, dismantling, or removal of wall coverings, insulation, floor coverings, or furnishings will be performed unless specified.

  • The Inspector will examine both the interior and exterior of the structure as allowed by accessibility.

4. Exclusions

The inspection does NOT include:

  • Identification of mold, mildew, or other non-WDI conditions

  • Damage caused by animals, moisture, or environmental issues

  • Evaluation of structural integrity or code compliance

  • Treatment recommendations or repair estimates (unless separately contracted)

5. Limitations

  • Inaccessible or obstructed areas (such as wall voids, locked rooms, or heavy storage) will not be inspected.

  • The report reflects the conditions present at the time of inspection only.

  • Wood-destroying insect activity may exist in concealed areas and may not be discovered during a visual inspection.

6. Client Responsibilities

  • Ensure all areas to be inspected are accessible at the scheduled time.

  • Notify occupants, sellers, or agents of the inspection and need for access.

  • Understand that no guarantees or warranties are offered by the inspection.

7. Report Delivery

The completed NPMA-33 form will be delivered to the Client in digital or printed format within 1 business day of the inspection.

9. Limitation of Liability

The Client agrees to hold harmless, indemnify, and release Alpine Elite Real Estate Solution, including its inspectors, employees, agents, and contractors, from any and all claims, losses, damages, or expenses arising out of or related to the Wood-Destroying Insect (WDI) inspection, including but not limited to:

  • Undetected infestations or concealed damage not visible at the time of inspection

  • Damage to the structure occurring before, during, or after the inspection

  • Recommendations or findings made by third parties or contractors based on the inspection report

  • Misinterpretation or reliance on the report by realtors, buyers, sellers, lenders, or others

  • Claims related to infestations developing after the inspection

The Client acknowledges and agrees that:

  • The WDI inspection is a visual inspection only, limited to accessible areas of the structure at the time of the inspection.

  • The inspector does not move furniture, lift flooring, open walls, or disturb insulation or finished surfaces.

  • The inspection does not constitute a warranty or guarantee of the absence of wood-destroying insects or related damage.

  • Infestations may be hidden, dormant, or otherwise not visible during the inspection and could become apparent later.

  • This inspection does not include treatment, repair recommendations, or pest identification beyond standard WDI categories (e.g., termites, carpenter ants, powderpost beetles).

Because of these limitations, the Client agrees and understands that no monetary compensation, refund, or payout of any kind shall be issued for:

  • Wood-destroying insect activity missed or not visible at the time of inspection

  • Future infestations or damage that occur after the inspection

  • Structural damage or loss in property value due to WDI activity

  • Any costs of pest treatment, control, repair, remediation, or renovation

The Client further acknowledges that the WDI inspection performed by Alpine Elite Real Estate Solution is not a substitute for ongoing pest maintenance and does not eliminate the possibility of infestation or related structural damage.

By signing this agreement, the Client accepts all risks associated with the limitations of a visual WDI inspection and agrees to indemnify and hold Alpine Elite Real Estate Solution harmless from any and all liability relating to past, present, or future WDI activity.

10. Entire Agreement

This Agreement contains the entire understanding between the parties. Any modifications must be made in writing and signed by both parties.

Client Acknowledgment

By signing below, the Client acknowledges that they have read, understood, and agreed to the terms of this Agreement and authorize Alpine Elite Real Estate Solution to perform a WDI inspection using the NPMA-33 protocol.

Mold Testing Agreement

Alpine Elite Real Estate Solution

This Agreement is made between Alpine Elite Real Estate Solution ("Inspector") and the undersigned client ("Client") for the purpose of collecting samples for mold analysis at the property listed below.

The Client understands and agrees that this service is limited strictly to mold sampling and laboratory testing. No mold inspection, visual assessment, or investigation of the source or cause of mold is included in this service.

This service consists solely of:

3. Exclusions

This agreement and service do not include:

  • Any visual or physical mold inspection

  • Evaluation of property conditions

  • Investigation or identification of moisture sources

  • Determination of mold cause or type beyond lab identification

  • Remediation recommendations or cost estimates

  • Health, legal, or environmental advice

4. Limitations

The Client understands that:

  • Samples represent only the specific locations and time they were collected.

  • Conditions may change, and results may not reflect the entire structure.

  • Negative or low results do not guarantee the absence of mold elsewhere.

5. Client Responsibilities

Client agrees to:

  • Provide safe, unobstructed access to sampling areas

  • Identify areas of concern where samples should be taken

  • Acknowledge that Alpine Elite Real Estate Solution is not liable for pre-existing damage, contamination, or future mold issues

6. Reporting

The lab report will be provided within 3–5 business days after sampling is completed and will include:

  • Mold genus identification (when applicable)

  • Spore counts and sample analysis

  • Laboratory interpretation only

No conclusions or analysis will be added by Alpine Elite Real Estate Solution beyond what is provided by the lab.

7. Fees

8. No Warranty or Guarantee

This service makes no representation, warranty, or guarantee as to the presence, absence, or health effects of mold. The Client understands that mold can be hidden, intermittent, or seasonal, and may not be detected in collected samples.

9. Limitation of Liability

The Client agrees to hold harmless, indemnify, and release Alpine Elite Real Estate Solution, including its inspectors, employees, agents, laboratories, and contractors, from any and all claims, damages, losses, or liabilities arising from or related to the mold testing services provided.

This includes but is not limited to:

  • Undetected or undisclosed mold presence outside of sampled areas

  • Health symptoms or concerns allegedly caused by mold

  • Misinterpretation of laboratory results by third parties

  • Decisions made based on test results, including repairs, remediation, or real estate transactions

  • Future mold growth or water intrusion after the date of testing

The Client understands and agrees that:

  • The mold service provided is testing only, not a mold inspection or assessment of causes, sources, or building conditions.

  • Alpine Elite Real Estate Solution does not perform moisture mapping, infrared scanning, or destructive testing as part of this service.

  • Testing is limited to specific areas where samples are collected, as selected by the Client or agreed upon during the appointment.

  • Mold spores are a naturally occurring part of the environment and may exist in both tested and untested areas.

  • The test results reflect the conditions present at the time of sampling only and do not predict future mold activity.

Alpine Elite Real Estate Solution is not a licensed mold remediation contractor or medical authority, and does not provide diagnoses, guarantees, or remediation recommendations. Any interpretation or use of lab results is the sole responsibility of the Client or their consultants.

Therefore, the Client agrees that no compensation, refund, or payout of any kind shall be issued for:

  • Missed or undetected mold growth

  • Personal injury or health issues allegedly related to mold exposure

  • Mold damage that appears or spreads after the testing date

  • Any costs associated with remediation, relocation, repairs, or dispute resolution

By signing this agreement, the Client acknowledges and accepts the limitations of mold testing and agrees to release Alpine Elite Real Estate Solution from any and all liability, now and in the future, related to mold presence, testing, or consequences thereof.

This Agreement contains the full understanding between the parties and may only be modified in writing, signed by both Client and Inspector.

Client Acknowledgment

By signing below, the Client acknowledges that they have read and understood this Agreement and authorize Alpine Elite Real Estate Solution to perform mold sample collection and submit the samples to a laboratory for analysis.

Rental Condition Inspection Agreement

  • Supporting security deposit or damage claim decisions.

3. Scope of Inspection

The inspection includes a non-invasive visual review of the following accessible areas and elements:

  • Interior: Walls, ceilings, floors, doors, windows, lighting, plumbing fixtures, appliances (if applicable), and HVAC registers.

  • Exterior: Visible condition of entryways, siding, driveway/walkways, garage doors, and landscape condition (if included in lease).

  • Additional Spaces: Garage, basement, attic, or any other areas included in the rental.

The inspection does not include:

  • Moving tenant or owner property

  • Operating appliances or systems

  • Entering locked or unsafe areas

  • Reporting on building code compliance, structural integrity, or pest/mold activity

4. Condition as of Time of Inspection

The Inspector's report reflects the visible and accessible condition of the property only at the time of the inspection.
No warranty, prediction, or guarantee is made about:

  • Future property condition

  • The cause of any existing condition or damage

  • Hidden, latent, or future defects

5. Deliverables

Client will receive a Rental Condition Report within [insert timeframe, e.g., 24–48 hours] including:

  • Descriptions and/or condition ratings for each room or component

  • Photographs documenting visible conditions

  • Noted deficiencies or damage (if applicable)

The report is intended to be factual and objective, not an evaluation of responsibility or cause.

7. Limitation of Liability

  • Disputes between tenants and landlords

  • Missed or undocumented cosmetic wear, damage, or personal property

  • Changes to the condition of the property after the time of inspection

  • Use or interpretation of the report by third parties, including legal professionals, property managers, tenants, or insurers

  • Costs or damages claimed as a result of perceived inaccuracies or omissions

The Client understands and agrees that:

  • The condition report is a snapshot of the property's condition at the time of inspection only, and may not reflect damage or changes that occur before or after the inspection.

  • The inspection is non-invasive, visual, and limited to readily accessible areas of the property.

  • Inspectors do not move personal belongings, test mechanical systems, or provide opinions on habitability or code compliance.

  • The report is intended for documentation purposes only and is not a warranty or guarantee of future property condition.

The Client further acknowledges that:

  • The presence or absence of photographs, notes, or checklists is subject to the inspector’s professional discretion.

  • Any post-tenancy or move-out comparisons must account for natural wear and tear and are not the responsibility of Alpine Elite Real Estate Solution.

  • The inspection does not determine responsibility or fault for damage, nor does it establish legal or contractual conclusions.

Accordingly, the Client agrees that no compensation, refund, or payout of any kind shall be issued for:

  • Disagreements over damages or wear and tear

  • Future claims or disputes between parties using the report

  • Missed items or subjective interpretations of condition

  • Any costs associated with repairs, replacements, or legal action

By signing this agreement, the Client accepts the limitations and purpose of the Rental Property Condition Report and agrees to indemnify and hold Alpine Elite Real Estate Solution harmless from any and all claims related to the report, the inspection process, or its use.

8. Entire Agreement

This Agreement represents the full understanding between Alpine Elite Real Estate Solution and the Client. Modifications must be in writing and signed by both parties.

Client Acknowledgment

By signing below, Client acknowledges and agrees to the scope, limitations, and terms of this Rental Condition Inspection Agreement. Client authorizes Alpine Elite Real Estate Solution to inspect the property and deliver a written condition report based solely on the current visual state of the property at the time of inspection.

Drone Photography & Videography Agreement

Alpine Elite Real Estate Solution

This Agreement ("Agreement") is made between Alpine Elite Real Estate Solution ("Service Provider") and the undersigned client ("Client") for the provision of drone-based photography and/or videography services ("Services") at the property located at:

1. Scope of Services

The Service Provider agrees to perform aerial drone photography and/or videography services for the Client at the above-listed property. The Services may include:

  • Aerial still photography

  • Aerial video footage (raw or edited)

  • Interior and exterior ground-level photos (if requested)

  • Basic post-processing/editing

  • Delivery of digital media via email or cloud link

Deliverables will be specified prior to the service date and confirmed in writing.

2. Client Responsibilities

The Client agrees to:

  • Provide clear access to the property and all areas to be photographed/filmed

  • Ensure that no hazards (e.g., low-hanging wires, aggressive animals, or restricted areas) prevent safe drone operation

  • Notify tenants or occupants, if applicable, that aerial imaging will occur

  • Obtain permission or approvals from any homeowners’ associations or municipal bodies if required

  • Ensure the property is photo/video ready at the scheduled time (clean, staged, no obstructions, etc.)

3. FAA Compliance & Operational Limitations

The Service Provider will:

  • Operate in compliance with FAA Part 107 regulations for commercial drone operations

  • Refrain from flying in restricted or controlled airspace without proper clearance

  • Not fly over people, moving vehicles, or beyond visual line of sight

  • Cancel or postpone flights due to unsafe weather conditions (e.g., high wind, rain, snow)

In the event that airspace restrictions or environmental conditions prevent drone use, ground-level services may be substituted or the appointment rescheduled.

4. Fees and Payment Terms

The fee for drone photography/videography services is ${{INSERT FEE}}. Payment is due:

  • In full prior to or at the time of service, unless otherwise agreed in writing

  • A late fee of 8% annually will be applied to past-due accounts

  • The Client agrees to cover all legal fees and costs related to collection of unpaid fees

5. Media Rights & Usage

  • The Client is granted a non-exclusive, royalty-free license to use the media for marketing, advertising, or other promotional purposes related to the listed property

  • Alpine Elite Real Estate Solution retains copyright ownership of all images and videos

  • The Service Provider reserves the right to use the footage for its own portfolio, promotional materials, or website unless otherwise requested in writing by the Client

  • Client may not resell, alter, or distribute the media for purposes outside of the intended property marketing without written permission

6. Limitation of Liability / Hold Harmless

The Client agrees to hold harmless and indemnify Alpine Elite Real Estate Solution, its agents, employees, and contractors from any and all claims, damages, or liabilities arising from:

  • Personal injuries or property damage occurring during or as a result of drone operations

  • Denied access, airspace restrictions, weather cancellations, or technical issues that prevent drone flight

  • Any loss of business, profits, or reputation resulting from the use or non-use of aerial media

  • Unauthorized third-party use of delivered media

In all cases, the maximum liability of the Service Provider shall not exceed the total fee paid for the service.

7. Cancellations and Rescheduling

  • Client must provide at least 24 hours’ notice for cancellations or reschedules

  • Cancellations made with less than 24 hours’ notice may be subject to a cancellation fee of up to 50% of the service fee

  • Services may be rescheduled due to weather, airspace restrictions, or safety concerns at the sole discretion of the drone operator

8. Dispute Resolution and Legal Venue

In the event of any dispute, the Parties agree to:

  • Attempt to resolve the issue informally

  • If legal action is required, jurisdiction will be limited to the county where Alpine Elite Real Estate Solution is based

  • The prevailing party in any legal dispute shall be entitled to recover attorney fees and costs

9. Entire Agreement and Severability

This Agreement contains the entire understanding between the Parties and supersedes any prior verbal or written agreements. If any portion of this Agreement is found invalid or unenforceable, the remaining terms will remain in full effect.

This Agreement is non-transferable and may only be amended in writing, signed by both Parties.

10. Acknowledgment

By signing below, the Client agrees to all terms stated above and acknowledges receiving a copy of this Agreement.

This includes general observations of the framing, visible plumbing, electrical rough-in, HVAC ductwork, and other elements present and exposed at the time of inspection.

The inspection is not intended to be exhaustive or code-compliant and is conducted in accordance with the Standards of Practice of the International Association of Certified Home Inspectors (InterNACHI) unless otherwise agreed in writing.

The inspection and report are intended solely for the Client’s personal and confidential use. No guarantee or warranty of any kind is provided or implied.

2. Exclusions and Limitations

The following items are outside the scope of this inspection:

  • Building code enforcement or compliance determination

  • Soil conditions, compaction, or grading analysis

  • Engineering calculations or structural load analysis

  • Installation quality of hidden or future systems

  • Proper installation of components per manufacturer specifications

  • Concealed defects or future performance of systems

  • Window or door operation unless accessible and installed

  • Items not visible or accessible due to weather, construction progress, or safety

3. Client Responsibilities

Client agrees to the following:

  • Secure permission for Inspector to access the property site

  • Ensure conditions are safe for a site visit at the time of inspection

  • Understand that the Inspector is not liable for construction progress delays or access limitations

  • Notify Inspector in writing of any complaints or concerns within 10 days of discovery

Client is encouraged to attend the inspection and ask relevant questions, understanding the limited and evolving condition of the property during pre-drywall stages.

4. Inspection Fee and Payment

The Client expressly acknowledges and agrees that:

  • The inspection is non-invasive and limited by the state of construction at the time

  • The Inspector is not responsible for inaccessible, incomplete, or future conditions

  • The inspection is for general information purposes only and does not supersede builder warranties or responsibilities

No monetary compensation, refund, or payout of any kind shall be issued by Alpine Elite Real Estate Solution for any reason, including but not limited to:

  • Missed or undetected issues

  • Construction defects

  • Builder errors or omissions

  • Any damages, injuries, or losses related to or arising from the inspection

This clause is a material part of the consideration given by the Client in hiring Alpine Elite Real Estate Solution and is agreed to knowingly and willingly with full understanding of its legal effect.

6. Dispute Resolution

In the event of any dispute, the Parties agree first to attempt informal resolution. If resolution cannot be reached, legal proceedings shall be brought in the jurisdiction where the property is located.

7. Severability

If any portion of this Agreement is found to be unenforceable, the remainder shall remain in full force and effect.

8. Entire Agreement

This Agreement represents the entire understanding between the Parties. No verbal statements, modifications, or prior writings shall alter or supersede this Agreement.

New Home Final Walkthough Agreement

This Agreement is made between Alpine Elite Real Estate Solution ("Inspector") and the undersigned client ("Client"), collectively referred to as the "Parties."

By signing this Agreement, Client acknowledges that they have read, understood, and agree to the terms and conditions outlined herein. The inspection will not be scheduled or performed without acceptance of this Agreement.

The purpose of this Final Walkthrough Inspection is to provide the Client with a limited visual evaluation of a newly constructed property prior to closing, typically conducted in conjunction with a builder's final walkthrough.

The inspection includes a general assessment of visible and accessible systems, finishes, appliances (if present and installed), and workmanship present at the time of the walkthrough. This is a non-invasive, non-code-compliance inspection intended to assist the Client in identifying obvious defects or incomplete items prior to final acceptance.

The inspection is conducted in accordance with the Standards of Practice of the International Association of Certified Home Inspectors (InterNACHI), unless otherwise agreed in writing.

The inspection and report are for the exclusive and confidential use of the Client and are not intended as a substitute for any final builder walkthrough or warranty documentation.

2. Exclusions and Limitations

The following items are excluded from the scope of this inspection:

  • Building code or municipal compliance verification

  • Structural engineering or design adequacy

  • Future system performance or durability of finishes

  • Appliance testing if not connected to utilities

  • Missed or undetected issues

  • Disputes or legal action related to builder agreements or warranties

  • Any indirect, incidental, or consequential damages

6. Dispute Resolution

In the event of any dispute, the Parties agree to attempt informal resolution first. Failing resolution, any legal action shall be brought in the jurisdiction where the property is located.

7. Severability

If any provision of this Agreement is found to be unenforceable, the remainder shall remain valid and enforceable to the fullest extent permitted by law.

8. Entire Agreement

This Agreement represents the full and complete understanding between the Parties. No verbal statements or external documents shall modify or supersede this Agreement.

The goal is to help the Client identify defects or issues that may be eligible for warranty coverage before the expiration of the builder’s obligations.

The inspection is non-invasive, not code-compliant, and does not guarantee that the builder will address or agree with the findings. The inspection will be conducted in accordance with the Standards of Practice of the International Association of Certified Home Inspectors (InterNACHI), unless otherwise specified in writing.

The inspection report is for the exclusive and confidential use of the Client.

2. Exclusions and Limitations

The following items are excluded from the scope of this inspection:

  • The Inspector is not acting as a builder representative, warranty advocate, or repair contractor

  • Builder cooperation with the report findings is not guaranteed

No monetary compensation, refund, or payout of any kind shall be issued by Alpine Elite Real Estate Solution for any reason, including but not limited to:

  • Future component failure

  • Builder refusal to honor warranty items

  • Bodily injury or property damage

  • Missed items or disputes regarding inspection accuracy

This clause is a material term of the Agreement and is entered into knowingly and voluntarily with full understanding of its legal effect.

6. Dispute Resolution

The Parties agree to attempt informal resolution of any dispute arising from this Agreement or the services provided. Failing resolution, legal action shall be brought in the jurisdiction where the inspected property is located.

7. Severability

If any part of this Agreement is found to be unenforceable, the remaining provisions shall remain valid and in effect.

8. Entire Agreement

This Agreement constitutes the entire understanding between the Parties. No verbal modifications, prior agreements, or outside documents shall modify or supersede this Agreement.
